TERMS & CONDITIONS

Ace Mountain Adventures (trading as Matt in the Mountains)

Please read these Terms & Conditions carefully before booking or participating in any activity or purchasing any online content. By making a booking or using our services, you agree to be bound by these Terms & Conditions.

 


 

1. About Us

Ace Mountain Adventures is operated by Matt in the Mountains, a UK-based provider of guided hill walking, mountain activities, navigation training, and online educational courses.

2. Scope of These Terms

These Terms & Conditions apply to:

  • Guided walks, courses, and expeditions

  • Training courses (including navigation and skills courses)

  • Online and digital courses and materials

  • All participants and purchasers

Separate documents may apply, including risk assessments, safety procedures, booking forms, and health declarations. These documents support - but do not replace - these Terms.

3. Booking & Payment

3.1 A booking is confirmed once:

  • Full payment has been received, and

  • A completed booking form has been submitted (where applicable)

3.2 Once confirmed, a legally binding contract exists between you and Ace Mountain Adventures.

3.3 Payment methods may include bank transfer, PayPal, or online payment systems, as specified at the time of booking.

4. Cancellations & Changes (Client)

4.1 Client Cancellations (In-Person Activities)

  • More than 4 weeks before the activity start date
    → Refund minus 35% of the total fee

  • Less than 4 weeks before the start date, or after the activity has begun
    → No refund

We strongly recommend suitable insurance to cover cancellation, curtailment, medical issues, and personal accidents.

4.2 Changes Requested by the Client

  • Requests to change dates must be made at least 4 weeks in advance of your course date

  • Changes are subject to availability

  • An administration fee of £50 may apply

  • No date changes are permitted within 4 weeks of the activity start date

5. Cancellations or Changes by Us

5.1 We reserve the right to cancel or modify activities due to factors including (but not limited to):

  • Weather or ground conditions

  • Safety considerations

  • Insufficient participant numbers

  • Instructor illness or unforeseen circumstances

5.2 If a major change occurs (defined as a change of location or a change to start/finish time of more than 12 hours), you may:

  • Accept the change

  • Transfer to another available activity

We are not responsible for additional personal expenses (e.g. travel, accommodation, equipment).

6. Participation, Risk & Responsibility

6.1 Hill walking and mountain activities involve inherent risks, including the risk of serious injury or death. By booking and then participating, you acknowledge and accept these risks. Ace Mountain Adventures cannot be held responsible for any injuries/death that may occur.

6.2 Participants are responsible for:

  • Following instructor safety briefings and instructions

  • Acting responsibly and within their capabilities

  • Informing us of any relevant medical or health conditions

6.3 The instructor’s decisions regarding safety, route choice, pacing, and group management are final. No responsibility can be held if these rules are not stuck too.

7. Health, Fitness & Medical Information

7.1 Participants must complete any required Health Declaration Form accurately and honestly.

7.2 You must inform us of any changes to your health or fitness prior to the activity.

7.3 Failure to disclose relevant medical information may result in exclusion from an activity without refund if safety is compromised.

8. Equipment & Personal Property

8.1 Participants are responsible for ensuring they have appropriate clothing and equipment as advised, this will be checked on the day of your activity and we hold the right to remove anyone that doesn't have the correct items that were sent out on the kit list.

8.2 All personal belongings are carried at your own risk. We accept no liability for loss or damage, including items left in vehicles.

9. Insurance

Participants are responsible for arranging adequate personal insurance covering:

  • Cancellation

  • Medical treatment

  • Personal accident

  • Repatriation (where relevant)

  • Personal equipment

10. Under 18s

10.1 Participants under 18 must be accompanied at all times by a parent or legal guardian.

10.2 Separate conditions may apply for organised youth programmes (e.g. DofE).

 


 

11. Media, Photography & Video

11.1 We may take photographs or video during activities for training and promotional purposes.

11.2 By booking, you consent to such use unless you notify us in writing before the activity.

12. Online Courses & Digital Content

12.1 Online courses and digital materials are provided for educational purposes only.

12.2 Content must not be:

  • Shared

  • Copied

  • Resold

  • Reproduced
    without written permission.

12.3 Online content does not replace professional instruction, formal qualifications, or personal responsibility for safety in the outdoors.

12.4 Access may be suspended or terminated if content is misused.

13. Data Protection & Privacy

13.1 Personal data is handled in accordance with our Privacy Policy, available on our website.

13.2 Information will only be shared with staff involved in delivering activities or where required by law or emergency services.

14. Complaints

14.1 Any concerns should be raised with the instructor at the earliest opportunity.

14.2 Unresolved complaints must be submitted in writing within 30 days of the activity end date.

15. Limitation of Liability

15.1 Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability which cannot be excluded under UK law

15.2 Subject to the above, Ace Mountain Adventures shall not be liable for:

  • Losses arising from inherent risks of outdoor activities

  • Indirect or consequential losses

16. Governing Law

These Terms & Conditions are governed by English law, and the courts of England and Wales shall have exclusive jurisdiction.

17. Acceptance

By making a booking or purchasing online content, you confirm that you have read, understood, and agreed to these Terms & Conditions.
